Terms of Service

These Terms of Service ("Terms") govern your use of onlinecooks.com (the "Site") and every purchase you make from Onlinecooks. Together with our Privacy Policy, Shipping Policy and Refund & Returns Policy, they form the agreement between you and us. Please do not use the Site if you do not accept them.

1. Who we are

Onlinecooks is the trading name of ERJH JE LLC, located in Chandler, AZ. We sell Kitchen & Cooking Essentials products online through the Site.

2. Who may order

You must be at least 18 years old, or be using the Site with the permission of a parent or legal guardian, to place an order. You agree that the details you give us at checkout, including your shipping address and contact information, are accurate and complete.

3. Products, prices and errors

Products are described as accurately as we can on their pages. We may change, replace or withdraw any listing at any time without notice. All prices are shown in USD and, unless stated otherwise, exclude sales tax; the full amount, including any tax, is displayed before you confirm payment. Shipping within the United States is free, so no delivery charge is added. If a price or description turns out to be wrong, we reserve the right to correct it and, where an order has already been placed at the incorrect price, to cancel that order and refund you in full.

4. Orders and acceptance

Placing an order is an offer to buy. We accept it when we dispatch the goods; until then we may decline or cancel an order, for example where stock is unavailable, where we suspect fraud, or where a pricing error has occurred. If you want to cancel an order yourself, email support@onlinecooks.com as soon as possible. Orders that have already been processed or shipped may no longer be cancellable, in which case the Refund & Returns Policy applies.

5. Payment

We accept Shop Pay, PayPal, Google Pay, Apple Pay, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken at checkout and processed securely by Shopify Payments. There are no hidden charges: the amount shown on the final checkout screen is the amount you pay.

6. Shipping

We ship to all 50 US states only; international delivery is not available. One free standard shipping service is offered on every order. Processing and transit times, tracking and related details are set out in the Shipping Policy, which forms part of these Terms.

7. Returns and refunds

Returns are accepted for manufacturing defects, damage in transit and incorrect items, within 30 days of delivery, under the conditions in our Refund & Returns Policy. That policy, which forms part of these Terms, sets out how to make a claim and how refunds are issued.

8. Your account

If you create an account you are responsible for keeping your password confidential and for everything done under your login. Tell us at support@onlinecooks.com immediately if you think someone else has accessed it.

9. Acceptable use

You agree not to:

• use the Site for any unlawful or fraudulent purpose;
• interfere with its security, availability or operation;
• scrape, copy or republish any part of the Site without our written consent;
• upload viruses or other harmful code;
• attempt to access areas of the Site or systems you are not authorised to use.

10. Intellectual property

Everything on the Site, including text, product photographs, graphics, logos and layout, belongs to Onlinecooks or is used under licence and is protected by intellectual property law. You may not reproduce, distribute or exploit it without our prior written permission.

11. No warranties

The Site and the products are provided "as is" and "as available". We work to keep information accurate and the Site running, but we do not guarantee that it will be uninterrupted, error-free or free of harmful components, and we make no warranties beyond those that cannot be excluded by law.

12. Limitation of liability

To the fullest extent permitted by law, neither Onlinecooks nor ERJH JE LLC is liable for any indirect, incidental, special, consequential or punitive damages, including lost data, revenue or profits, arising from your use of the Site or from any product purchased through it. Where liability cannot be excluded, it is limited to the amount you paid for the order concerned.

13. Indemnification

You agree to indemnify and hold harmless ERJH JE LLC, its officers and employees against any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

14. Privacy

Our Privacy Policy explains how we collect and use your personal information. By using the Site you agree to it.

15. Governing law

These Terms are governed by the laws of the State of Arizona and the United States. Any dispute arising from them or from your use of the Site will be heard by the courts located in State of Arizona.

16. Changes

We may update these Terms at any time. The current version, with its effective date, is always published on this page, and continuing to use the Site after a change means you accept the updated Terms.
